Terms of Service

Effective Date: June 1, 2025

1. Introduction

Welcome to POWERinU’s ONLINE LEARNING HUB (the “Platform”), owned and operated by POWERinU Training and Coaching Philippines, Inc. (“we,” “us,” or “our”). By accessing or using the Platform, you agree to comply with and be bound by these Terms of Service (TOS).

If you do not agree to these terms, please do not use the Platform.

2. Eligibility

By using the Platform, you confirm that you:

  • Are at least 18 years old (or have parental/guardian consent if under 18).
  • Have provided accurate, complete, and up-to-date registration information.
  • Will comply with all applicable laws and regulations.

3. Account Registration & Security

  • Users must create an account to access courses and subscriptions.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • Any unauthorized use of your account must be reported to us immediately.

We reserve the right to suspend or terminate accounts found to be fraudulent, misused, or in violation of these Terms.

4. Subscription Plans & Payment

A. Free Trial

New users can avail of a 7-day free trial, after which they must subscribe to continue accessing the Platform.

B. Subscription Options

  1. Regular Subscription: Access to all online courses.
  2. Premium Subscription: Access to all online courses plus:
    1. A complimentary 30-minute coaching/mentoring session
    1. 1 free coaching/mentoring session for every 6 paid sessions
    1. Priority access to POWERinU coaches via email scheduling

C. Payment & Billing

  • All subscriptions are billed on a recurring basis unless canceled.
  • Payments are processed through secure third-party payment providers.
  • We are not responsible for fees imposed by your bank or payment provider.

D. Cancellation & Refunds

  • Subscriptions can be canceled at any time via account settings, but access remains active until the end of the billing cycle.
  • Refunds are not provided for partial subscription periods unless legally required.

5. Course Access & Intellectual Property

All courses, materials, and content on the Platform are owned by POWERinU or its licensors and are protected by copyright laws.

  • You MAY NOT:
    • Copy, distribute, or resell course materials.
    • Share login credentials with others to access paid content.
    • Record, reproduce, or share any content without written permission.
  • You MAY:
    • Access courses for personal or professional development.
    • Download resources explicitly made available for learners.

Violating these terms may result in account suspension or legal action.

6. Coaching & Mentoring Services

Premium subscribers are eligible for coaching/mentoring sessions, which must be scheduled via email at [[email protected]].

Terms for Coaching Services:

  • Sessions are subject to availability.
  • Rescheduling requires at least 24-hour notice.
  • Missed sessions without prior notice are considered forfeited.

7. User Conduct & Community Guidelines

We foster a respectful learning environment and expect users to:

  • Engage in discussions professionally and courteously.
  • Avoid harassment, discrimination, or offensive language.
  • Not upload or share inappropriate, harmful, or misleading content.

We reserve the right to remove users violating these guidelines.

8. Limitation of Liability

  • We strive to provide a high-quality learning experience but do not guarantee specific learning outcomes or career advancements.
  • The Platform is provided “as is” without warranties of any kind.
  • We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Platform.

9. Privacy & Data Protection

Your data is handled per our Privacy Policy. By using the Platform, you agree to:

  • The collection and processing of personal information as outlined in our Privacy Policy.
  • The use of cookies and tracking technologies for platform optimization.

10. Termination & Account Suspension

We reserve the right to:

  • Terminate accounts violating our Terms.
  • Suspend access for non-payment or suspicious activity.
  • Discontinue services or modify subscription plans with prior notice.

11. Changes to Terms of Service

We may update these Terms from time to time. Continued use of the Platform after changes constitute acceptance of the new Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by Philippine law. Any disputes shall be resolved through mediation and arbitration before pursuing legal action.
